2026 POOL AND COMMUNITY CENTER USER AGREEMENT

I hereby certify that I have read, and agree to comply with all the provisions of the 2026 “Policies for Use of the Pool” as they are approved by the Board of Directors.

I further agree that my use of the Swimming Pool Area and its related facilities is generally on an unsupervised basis and is at my sole risk, responsibility and liability. I hereby agree on behalf of myself, my family, other occupants that reside at the noted address, and my guests to indemnify and hold free and harmless the Association, the Board of Directors, and Managing Agent from any and all claims of any nature arising from my use of the Pool and Community Center and its related facilities.

I hereby accept full responsibility for any and all damages to the Pool and Community Center and its related facilities, equipment, furnishings, and accessories arising from my use of the Pool and Community Center and its related facilities. I have also relayed this information to all members of the household and will review with any guests I bring to the pool.

I understand that my Fallston Commons Pool privileges are non-transferrable. I have been provided and have read the pool rules and guest policy and agree to indemnify the property and the pool management company from any loss incurred as a result of my failure to comply with those rules. As a parent or guardian, I understand my primary responsibility is for the safety of the individual(s) under my care. Also, I understand if I list persons as additional full-time residents of my household who are not living there full-time that Pool use privileges may be suspended for the entire household.

2026 Policies for Use of the Pool

Pool Rules:

Residents and their guests use the pool facilities at their own risk. The Association assumes no responsibility for any accident or injury in connection with such use or for any loss or damage to personal property.

  1. Upon entering the pool area, residents must sign in with the guard and enter their name, address and number of guests. All residents must sign out when they leave for the day.
  2. Every full-time resident of each household will have access to the pool once a proper Pool Use and Community Center User Agreement has been signed and submitted for the year, subject to #22 below.
  3. No person is permitted in the swimming pool unless it is officially open, and the lifeguard is in the lifeguard chair. Pool hours will be posted at the pool. The pool hours for 2026 are DAILY: 12:00pm-8:00pm. These hours are subject to change based on lifeguard availability.
  4. Lifeguards are present to ensure the safety of all residents/guests. A parent or responsible adult (19 or older) is responsible for their children and guests at all times.
  5. Glass containers of any kind are not permitted inside the pool fence. No food or drink is permitted in the swimming pool or immediate area surrounding the pool. Offending residents shall be responsible for any claims, accidents, injuries and damages should alcohol play any part in an event at the pool.
  6. Everyone MUST dry off prior to entering the restrooms.
  7. No sitting or congregating on the stairs near the handrails. Everyone must leave the water, including clearing the stairs, when the lifeguard is on break.
  8. No pets are permitted inside the fenced area.
  9. Water guns are prohibited except when used in organized events with Pool management approval.
  10. Diving or running is not permitted.
  11. Smoking, vaping and/or electronic or e-cigarettes is prohibited in the community center, the pool area, and the surrounding grounds.
  12. Radios/music devices may be played only with earphones, at a volume that does not disturb others (except for community sponsored events).
  13. Regarding flotation devices, the only flotation devices permitted include pool noodles and Coast Guard -approved life vests. All children who are non-swimmers must wear the US Coast Guard-approved life vest. An adult (age 18 or over) must supervise non-swimmers and be within arm's reach of them at all times.
  14. Chairs/tables may not be reserved or held when users are not present. To avoid damage, moving of tables is strongly discouraged.
  15. No grills are permitted.
  16. Anyone with open lesions or sores is not permitted in the pool.
  17. Appropriate clothing and swimwear are required in and around pool/pool deck area.
  18. The pool may be closed at any time due to weather (rain, thunder, lightning, etc.), equipment failure, operational defects, Harford County inspections, or other unavoidable causes.
  19. Proper respect and cooperation are due to the lifeguards, who are to provide for the safe and orderly operation of the pool. All users must abide by the rules, and the lifeguards have the authority to enforce the rules. The lifeguards, pool committee, or HOA Board members may demand that any resident/guest leave the pool area if the rules are not being followed and/or pool/community center privileges may be revoked. Specifically, a resident/guest engaged in unsafe or disruptive behavior (not limited to, but including, throwing, pushing and shoving of persons) will initially be given a warning to cease behavior. If the behavior is not corrected, the lifeguards have the authority to ask the resident/guest to leave the pool area. In extreme cases (including but not limited to using profane language or being physically confrontational), the lifeguards are NOT required to give a warning and can require the resident/guest to leave the pool area immediately.
  20. Lessees must submit a letter from the homeowner to Pelican Property Management that states the relinquishing of privileges to all Fallston Commons amenities to the lessee.
  21. Prolonged underwater swimming, breath-holding or games including such behavior are prohibited.
  22. Any household in arrears greater than 60 days for HOA or Condo assessments or fees, or that has not completed the Unit Residential and Age Verification Form will not be granted pool privileges until such time as they comply.

Guest policy

  1. Each household will be allowed four (4) free guest entries per day throughout the pool season. Household is defined as all residents living at the same address.
  2. RESIDENT(S) MUST BE PRESENT WITH GUEST(S) AT ALL TIMES. If a resident must leave the area temporarily, he/she must notify the guard. If such resident has not returned in 15 minutes, their guests will be asked to leave. At no time may anyone under the age of 19 remain without the resident or responsible adult being present.
  3. Parent/guardian adult must always closely watch children and must always accompany a non-swimmer in the water.
  4. Children who are not toilet-trained must wear a swim diaper in the pool.
  5. For community functions, the guest policy will be communicated by the event sponsor.
  6. Resident-only time will be as follows:
    Monday & Wednesday: 6pm-8pm
    Sunday: 12pm-2pm
    All other times guests (limit 4 per household) will be permitted.
    There will be NO resident-only times on the weekends of Memorial Day (May 23-25), Fourth of July (July 4-6) and Labor Day (September 5-7).
    There will be NO resident- 21st, 2025.
    Guests are not permitted in the pool area during the above hours except for the Policy.
    The Pool and Outdoor Recreation Committee defines a plus one as a person who would be qualified to live full time in Fallston Commons.
  7. Upon entering the pool area, residents must sign in with the guard and enter their name, address and number of guests. All residents must sign out when they leave for the day.
  8. All personal items and furniture must be removed from the pool area when residents leave the pool area. Absolutely no personal furniture, tents, floatation devices or belongings may be left or stored in or around the pool area including restroom lockers. There should be no unaccompanied furniture/belongings at the pool at any time.
  9. Lap lane is to be used for exercise and swimming laps only for a maximum of 30 minutes.

Disclaimer of Liability

All persons making use of the pool and community center and guest pass privileges and using any of the community common grounds recreational facilities agree to abide by the rules and regulations for the use of the facilities. Use of facilities is at the user's sole risk and responsibility.

The Association does not assume responsibility for any occurrence, accident, or injury in connection with such use. No owner shall make any claim against the Board of Directors, the Association, their servants, agents, or employees, for or on account of any loss or damage to life, limb, or property sustained because of or in connection with any such use of any of the recreational or common facilities. Each owner shall hold the Board of Directors, the Association, committees and managing agent harmless from any and all liabilities and any action of any nature by any tenants, guests, invitees or lessee of such owner as a result of the use of the recreational or common facilities, except where such loss, injury, or damage can clearly be proved to have resulted from and been proximately caused by the direct negligence of the Board, the Association, or their agents, servants, or employees in the operation, care, or maintenance of such facilities.

Any damage to the building, recreational facilities, or other communitity areas or equipment cuased by an owner or such owner's guests shall be repaired at teh expense of the owner.
