Witnesses: That the Landlord leases to the Tenant and the Tenant leases from the Landlord, the premises/PWC ramp:
in the Oyster Cove Boat Basin Condominium regime under the following terms and conditions:
and shall be paid in full prior to the PWC season. Any nonpaid fees will cancel the rental agreement and the PWC slip assigned will be given to those tenants on a waiting list.
Tenant is responsible for any damage caused to the premises. Tenant agrees to observe the Oyster Cove Boat Basin Rules and all restrictions and conditions imposed by the Declaration of Covenants, the Bylaws and the Rules and Regulations of the Oyster Cove Boat Basin Condominium.
All Coast Guard Rules and Regulations pertaining to PWC's must be followed at all times. It is the responsibility of the operator of the PWC to abide by these rules.
A copy of the Boat Basin documents and Oyster Cove Resident Information Packet is available from Pelican Property Management and on the website.
I hereby certify that the liability insurance carried on my PWC is a minimum of $500,000 Liability as required by the Boat Basin covenants and will provide the insurance COI naming Oyster Boat Basin Condominium Association as an additional insured with this completed form.
Tenant shall indemnify (by counsel reasonably acceptable to Oyster Cove Boat Basin Board) and hold harmless the Oyster Cove Boat Basin Board and it's officers, directors, agents and employees from and against claims, damages, losses and expenses, including but not limited to attorney's fees arising out of or resulting from the negligence or misconduct, any and all acts of Tenant in connection with use of PWC docks as described in this Rental Agreement.
